Employees who use their own vehicles for business travel are referred to as the ‘Grey Fleet’. Unfortunately employers are failing to adequately police these vehicles or the employees who drive them, these vehicles are not serviced or maintained correctly, businesses are not checking MOT certificates and are failing to make sure that these vehicles are adequately insured for use on company business.

Whether employees are driving a company car, a vehicle purchased through a car-for-car scheme or using their own car for business use. The new Corporate Manslaughter act adds further pressure. The Act further re-enforces the obligation on a company to comply with existing health and safety legislation. It is the employer’s responsibility to ensure the vehicles are roadworthy . if companies are going to let employees use their own cars for business, it is the employer’s responsibility to ensure employees are making essential safety checks and the following areas are covered.

1. The driver holds a current driving license – A checking service is available through AVS

2. The vehicle is insured for business use

3. The car is roadworthy and has a current MOT (if more than 3 years old)

4. Make sure the cars are regularly serviced

5. The employee is carrying out basic maintenance checks such as oil, washer fluid, tyre pressures

6. The employee has membership of a roadside recovery organisation
